A. Kirk Gasperecz

Kirk Gasperecz joined Adams and Reese in 1986, and he is an experienced tort and commercial litigator in state and federal courts. In addition to his bar admissions in Louisiana and Texas, Kirk has been admitted pro hac vice to defend clients in lawsuits filed in California, Maine, Mississippi, Pennsylvania and Washington, DC.

Kirk has extensive experience and is skilled in Tort, Products Liability, Construction and Insurance law. When advising clients, he is always responsive and mindful of the balance between the upside of litigation and the costs of devoting money, time and attention away from the needs of the client’s business.

His significant contributions include:

Defending manufacturers of cranes, derricks and other lifting devices, manufacturers of consumer products, testing laboratories, oil and chemical producers, general contractors, elevator service companies, restaurants, schools, insurance companies and governmental bodies.
Representing insurance companies in coverage disputes, first party claims and bad faith litigation.
Representing businesses to recover their losses and expenses under insurance policies as in Texaco Expl. & Prod., Inc. v. AmClyde Engineered Prod., Inc., 448 F.3d 760 (5th Cir. 2006) (affirming a $2.53 million award of defense costs under a builder’s risk policy).
Co-writing a law review article advocating a change in the law that was cited by the Louisiana Supreme Court in Gauthier v. O’Brien, 618 So.2d 825 (La. 1993)(overruling cases that held the fault of a tort-immune employer cannot be quantified by the finder of fact).
Helping insurers get a fair and proper result when their policies are interpreted as in McWright v. Modern Iron Works, Inc., 567 So.2d 707 (La. App. 2nd Cir. 1990) (reversing judgment requiring excess insurer to drop down).

Kirk most admires and tries to model people who quietly give back to their communities or professions through civic, charitable and professional involvement—not to garner attention, but simply because it’s the right thing to do. He also enjoys spending time with his family and cheering for the LSU Tigers.
