Albert L. Hogan III

Al Hogan concentrates on commercial litigation at the trial and appellate levels of the state and federal courts. Mr. Hogan’s practice focuses on complex business disputes with an emphasis on achieving rational business solutions or efficient judicial resolutions of such disputes. He has represented a broad range of clients in high-priority cases involving merger and acquisition disputes, commercial contracts, intellectual property, securities class actions, ERISA class actions and corporate control challenges. Mr. Hogan also has significant experience in bankruptcy litigation and has represented debtors, committees and creditors in core bankruptcy issues as well as proceedings related to bankruptcies.

Mr. Hogan has counseled Russian steelmaker OAO Severstal and its North American subsidiaries in multiple matters, including as lead trial counsel in several commercial disputes and as general strategic litigation counsel related to various merger and acquisition issues. Mr. Hogan also represented Moser Baer India, Ltd., one of the largest manufacturers of CDs and DVDs in the world, as its principal and coordinating counsel in a licensing and patent dispute involving litigation in the United States, the Netherlands and India.

Mr. Hogan has been the lead litigation partner handling the Chapter 11 proceedings of Delphi Corporation, which is one of the largest industrial restructurings in United States history. On this matter he has litigated many of the company’s key contested restructuring initiatives and has taken to trial numerous significant claims and adversary proceedings and resolved securities and ERISA class action claims. Mr. Hogan currently is representing the official committee of unsecured creditors in the American Airlines restructuring. He is also presently involved on behalf of an investor defending against clawback actions in the Lancelot Securities hedge fund liquidation. Mr. Hogan previously has been involved in several other bankruptcy and restructuring matters, including both plaintiff and defendant representations involving fraudulent transfer and preference action claims, as well as advising clients in connection with commercial transactions and out-of-court restructurings.

In addition, Mr. Hogan has counseled CME Group Inc. on several litigation matters, including both private civil matters and regulatory matters. He also has represented Ameriprise Financial, Inc. in a number of regulatory enforcement matters before the Securities and Exchange Commission and the Financial Industry Regulation Authority related to mutual fund sales practices.

Mr. Hogan has represented Anheuser-Busch on various matters, including regulatory issues and ERISA matters. Mr. Hogan currently is representing Pfizer and Bank of America in ERISA class actions. He also was one of the principal trial lawyers from the Skadden team representing the Mosaic Company in a dispute regarding a merger and acquisition dispute, and he continues to represent Mosaic in a variety of matters.
