Andrew C. Whitney

Andrew C. Whitney is an associate in Morgan Lewis's Litigation and Intellectual Property Practices. He represents corporations in intellectual property disputes and complex commercial litigation. Mr. Whitney's practice focuses on intellectual property litigation, including actions relating to patents, trademarks, copyrights, and trade secrets. He has litigated patent actions involving computing and information technology, as well as manufacturing and mechanical devices. Mr. Whitney has also handled complex commercial actions, including securities class actions and actions involving the financial services industry. He handles all aspects of litigation from from inception through trial and post-trial appeals in actions throughout the United States.

Mr. Whitney's recent experience includes:

Intellectual Property Actions

Represents an international publishing company against copyright infringement suits brought throughout the country. Recently obtained summary judgment for client on all claims in two of those suits.

Defended a major telecommunication and wireless equipment company in the District of Delaware against allegations that applications and direct carrier billing functionality infringed patents

Represented a manufacturer of fire protection products in numerous actions in the Eastern District of Pennsylvania and the Southern District of New York in connection with their enforcement and licensing of patent portfolios covering innovative fire protection technologies

Represented a non-profit organization that administers standardized tests in a copyright infringement action in the Eastern District of Pennsylvania and obtained consent order against defendants

Represented a major manufacturer of liquid crystal displays in multiple patent infringement actions in the District of Delaware

Complex Commercial Actions

Represented a major business software company in a breach of contract and fraud suit brought in Houston state court and involving the multimillion dollar sale and implementation of a revenue management system

Represented the former owner of a biotech manufacturing company in a series of six actions in Pennsylvania and Florida stemming from the sale of the company

Represented the directors and officers of a manufacturing company in an adversary proceeding in the United States Bankruptcy Court for the Western District of Pennsylvania

Represented the directors and officers of a financial services firm in a securities class action in the Court of Common Pleas of Philadelphia

Represented an international telecommunications company in a shareholder dispute in the United States District Court for the Eastern District of Pennsylvania

Mr. Whitney also maintains an active pro bono practice, having represented numerous children in connection with the Support Center for Child Advocates . He has also represented clients in various civil rights actions, including two cases brought under § 1983, and was lead trial counsel in a Bivens action relating to the cruel and unusual punishment of a prisoner.

Mr. Whitney serves on the Litigation Committee of the Intellectual Property Owners Association (IPO) and is a volunteer at the Hospital of the University of Pennsylvania. He is also a member of the Advisory Board of the Field Center at the University of Pennsylvania. The Field Center focuses on the well-being of abused and neglected children and is a collaboration of the University's Schools of Social Policy & Practice, Law, Medicine, and Nursing and the Children's Hospital of Philadelphia. The Field Center integrates clinical care, research and education, and informs local and national policy, for the benefit of children and their families.

Mr. Whitney earned his J.D. from the University of Pennsylvania Law School in 2005. He received his M.A. in behavioral neuroscience from Dartmouth College in 2000 and his B.A. in biology and psychology from Johns Hopkins University in 1997.

Mr. Whitney is admitted to practice in Pennsylvania and before the U.S. Supreme Court, the U.S. Courts of Appeals for the Third, Tenth, and Federal Circuits; the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania; and the U.S. District Court for the District of Colorado.
