Ashley M. Pavel

Ashley Pavel is an associate in O’Melveny’s Newport Beach office and a member of the Financial Services Practice. She represents clients in a variety of complex litigation matters, including consumer class actions involving claims under the Fair Debt Collection Practices Act, the Real Estate Settlement Procedures Act, the Fair Housing Act, the Equal Credit Opportunity Act, and the consumer protection statutes of numerous states, including California Business & Professions Code Section 17200. She also advises clients regarding regulatory and compliance matters involving mortgage servicing and foreclosure practices. Before joining O’Melveny, Ashley worked as an intern at the Electronic Frontier Foundation, an international non-profit digital rights advocate and legal organization based in San Francisco.

Advises mortgage servicers regarding compliance with OCC and OTS consent orders relating to residential foreclosure.
Represents several mortgage servicers and originators in a number of state attorneys general investigations, class actions, and bankruptcy-related litigation.

Obtained affirmance by California Court of Appeal of an order sustaining demurrer without leave to amend of unfair debt collection and unfair business practices claims.
Obtained summary judgment in mortgage servicer’s favor of adversary proceeding challenging servicer’s standing to file proof of claim.
Represented one of the largest subprime mortgage servicers in several class actions consolidated into a federal multi-district litigation proceeding, involving federal- and state-law claims related to mortgage servicing practices.
Represented mortgage servicer in lender placed insurance investigation by state regulatory agency.
Representing mortgage servicer in third-party subpoena in action involving diligence performed in connection with mortgage-backed securities.
Member of a team that obtained decertification of a nationwide class of 129,000+ African American borrowers in mortgage lending discrimination disparate-impact ECOA/FHA case.
Obtained awards on behalf of pro bono clients in connection with uncompensated labor during the German occupations of Hungary and Poland.
