Bran Noonan is a partner in the Labor & Employment Practice Group and focuses his practice on employment litigation and counseling. He has extensive experience representing businesses in both state and federal courts, before state and federal administrative agencies, and in arbitrations in a wide-range of employment and labor matters, including FLSA, ADA, Title VII, FMLA, ADEA, NLRA, New York Human Rights and Labor Laws, as well as in traditional labor law matters, such as grievance arbitrations and claims asserted before the NLRB. He also regularly represents clients in various complex commercial matters, such as those involving issues of unfair competition, restrictive covenants, breach of contract, breach of fiduciary duty, and fraud.
In addition, Bran routinely counsels his clients in various matters to ensure compliance with federal, state, and local fair employment laws and to reduce the risk of litigation. Bran provides counsel on various matters, such as those involving policy and procedure implementation and roll-outs, terminations and reductions in force, internal investigations, employee discipline, and reasonable accommodations, benefits, and leave of absence related issues. He also conducts wage and hour compliance audits and counsel. He also audits and prepares legally required and best practice employee and operational policies, manuals, handbooks, forms, and notices. Bran also provides employee and management training on an array of topics that include employee professionalism and sensitivity; anti-harassment and diversity; hiring best practices; conducting and resolving internal investigations; reasonable accommodation and leave compliance; and wage and hour compliance. Bran has also negotiated and prepared numerous commercial and employment contracts, such as severance, employment, advertising, service, non-disclosure, non-compete/non-solicitation, joint venture, and license agreements. He has experience working with employers in various industries including, education, hospitality, parking services, manufacturing, financial, media, real estate, healthcare, retail, food service, and restaurants.
Bran also defends companies against public accommodation and access claims under Title III of the ADA. He also provides comprehensive public access compliance counsel and advice in order to help companies ensure compliance or to help bring them into compliance with applicable regulatory standards of public accessibility.
