Brian W. Oaks

Brian Oaks is experienced in all areas of intellectual property law, including patent prosecution, patent litigation, technology licensing and patent portfolio development and management. He manages the development of strategic patent portfolios in a wide range of technologies, from mechanical/industrial devices (including sporting goods and manufacturing equipment) to telecommunication networks (including optical networking components, routing and switching technology, Internet telephony and telecommunications software) to numerous types of business processes.

Mr. Oaks has also represented clients in a number of patent infringement lawsuits and in arbitration proceedings involving disputes relating to patent licenses. He has been part of successful patent infringement lawsuits relating to the financial industry, the telecommunications industry and the multimedia software industry.

Mr. Oaks regularly counsels clients to help them identify, protect, and leverage their intellectual property assets and to manage offensive and defensive assertions of intellectual property rights. He also works with his clients to evaluate, manage, and respond to claims of infringement and regularly prepares opinions of counsel for his clients in response to such claims.

Mr. Oaks has extensive experience facilitating business transactions involving intellectual property rights. He drafts and negotiates agreements directed to the licensing and sale of technology assets. In addition, he manages intellectual property issues and drafts agreements associated with corporate transactions involving technology companies, such as mergers, acquisitions, asset purchases and capital investments.
