Kim Seneker recently retired as a partner in the firm and is currently serving the firm in the capacity of senior of counsel. Mr. Seneker's practice remains centered upon the negotiation and documentation of commercial real estate transactions, and delivery of related advice and assistance to clients regarding legal issues and concerns affecting real estate development, construction, investment, lending, leasing, and operational matters. He has a wealth of experience in all aspects of real estate law, land use, and zoning matters, as well as complex secured and unsecured financing transactions.
Having been in private practice for more than 35 years with Morrison & Foerster, Mr. Seneker has been exposed to a number of cyclical turns affecting the real estate markets, and has worked on some of the most sophisticated projects and transactions in both recessionary and growth environments. Mr. Seneker possesses unsurpassed expertise, skills, focus on the task at hand, and commitment to clients. He is able to provide clients the highest quality, most efficient and comprehensive approach to all assignments, and he regularly works with our other real estate attorneys on client matters requiring special senior expertise or involvement.
Over the years, Mr. Seneker has worked on lending and investment transactions involving properties and projects valued, in the aggregate, in the several billions of dollars. He has successfully negotiated and documented a number of high-profile transactions in the real estate arena, including in recent years the $1 billion+ sale of a portfolio of properties in the Silicon Valley on behalf of Peery/Arrillaga; the ground leasing, development, and operation of the highly successful Classic Residence by Hyatt continuing care retirement community (CCRC) in Palo Alto; and the acquisition, sale, or financing of numerous significant hotel properties, including the Regent Beverly Wilshire Hotel, the LAX Hilton, the Bonaventure Hotel, the Biltmore Hotel, the Westin Mission Hills Resort, the Four Seasons Hotel Newport Beach in Southern California and the Clift Hotel, the Mandarin Hotel, the Pan Pacific Hotel, the Hotel Nikko, and the Campton Place Hotel in San Francisco. Mr. Seneker also has acquired significant expertise during several recessionary periods in handling a large variety of debt restructuring, workout, foreclosure, and loan enforcement matters on behalf of an extensive number of local, regional, and national banks, securitized investment vehicles, insurance companies, pension funds and advisors, investment funds, and other participants in the real estate financing markets. He has also represented large debtor entities in their efforts to reorganize and restructure their real estate secured financing obligations.
Given his vast experience in real estate law and practice over numerous years of practice in both Northern and Southern California, Mr. Seneker is able to offer clients a unique perspective in structuring and negotiating deals in any real estate market throughout the state, and to provide top-level senior representation of clients in their real estate development, investment, and financing transactions as well as their property operations.
