Christa Rock advises clients in matters related to Insurance coverage litigation, complex civil and commercial litigation, and environmental compliance and enforcement. Her practice is focused on complex litigation matters, primarily insurance coverage and environmental disputes. In her civil litigation practice, Christa specializes in a wide variety of insurance matters involving allegations of extracontractual liability, including bad faith, tortious breach of contract, third-party bad faith, declaratory judgment actions, breach of the duty to defend, alleged statutory violations, and cases involving alleged errors in underwriting, agency communication, and misrepresentations on insurance applications. She has experience in litigation relating to a variety of coverage types, including commercial general liability, product liability, pollution coverage, automobile insurance, and property and casualty insurance.
In her environmental practice, Christa provides counsel on compliance and enforcement matters related to the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Clean Air Act, and the Clean Water Act. She has particular experience in the litigation of environmental claims during and following bankruptcy proceedings, having assisted in environmental bankruptcy claim estimation proceedings during a large corporate bankruptcy as well as successfully defending against CERCLA contribution claims brought by the surviving entity. She has developed appellate experience on environmental claims including CERCLA contribution, CERCLA subrogation, contribution protection, res judicata, judicial estoppel, and environmental cost recovery. In the administrative realm, Christa has helped clients reach settlements in multiple environmental and health and safety matters, including responding to CERCLA special notice letters, finalizing and implementing CERCLA consent decrees, negotiating the civil settlement of alleged Clean Air Act violations, and favorably resolving the largest OSHA citations ever levied against a wind energy company.
