Daniel E. Alberti is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Silicon Valley office, of which he is partner-in-charge. Dan also serves as the head of the Silicon Valley Trial practice. He focuses his practice on complex litigation matters, including commercial disputes in the Intellectual Property areas of trademarks, patents, copyrights and trade secrets. Daniel has represented clients in the following industries: semiconductor, telecommunications, medical devices, dietary supplements and health care.

Daniel served as a senior trial attorney in the San Francisco District Attorney’s office, where he handled both criminal and civil litigation, including a consumer fraud case that was at the forefront of the California Unfair Business Practices Act.

With more than 30 years of trial experience, Daniel has tried a wide range of cases in all of the San Francisco Bay Area courts. His trial experience includes a three-month long patent infringement case, trademark cases from infringement to trademark licensing, and multiple high-stakes commercial disputes. He has been involved in numerous injunction proceedings throughout California. Representing plaintiffs, Daniel has obtained multi-million dollar awards in arbitrations in forums around the United States. Daniel’s litigation management background includes the representation of the Manville Personal Injury Trust as lead trial counsel for the five western United States. He has been chosen by CEOs and General Counsel to handle high-stakes litigation at various stages of court proceedings.

Daniel has served as a faculty member of the Hastings College of Advocacy, and continues to assist Bay Area students in mock trial and litigation related programs.

Daniel holds membership in the California Bar and all Federal District Courts in the State of California.
