David Burgert has focused on the trial and appeal of commercial disputes for 30 years. He has tried more than 50 cases to jury verdict as lead counsel. David represents plaintiffs and defendants in state and federal courts and before arbitration panels of the American Arbitration Association, JAMS, and the N.A.S.D. and has argued appeals before Texas and federal appellate courts. He litigates aspects of internet cyberpiracy, trademark law, licensing litigation, as well as patent disputes, representing both patent holders and accused patent infringers.
Prior to joining Jones Day, David represented the owners of several patents covering an oil field tool used to improve drilling fluid life and well penetration rates. Litigation of these cases (involving five patents and nearly 200 claims) before Texas and Oklahoma juries resulted in willful infringement findings and substantial settlements for the client. In addition to his extensive intellectual property litigation experience, David has tried or arbitrated cases involving issues of fraud, lender liability, real estate disputes, oil and gas royalty disputes, oil field equipment failure, software development contracts, adverse possession, take-or-pay gas contracts, U.C.C. questions, broker/customer disputes, ERISA, and the Texas Deceptive Trade Practices Act. He also has conducted internal investigations concerning alleged improper business procedures, inadequate accounting controls, and/or employee misconduct.
David is a member of many legal organizations, including the American Board of Trial Advocates and the American Intellectual Property Lawyers Association. He is also a Life Fellow of the Texas and Houston Bar Foundations.
