David M. Levy

David Levy is co-head of Venable's Postal Law Practice Group. He has a national practice helping mailers – from Fortune 100 companies to small nonprofit organizations – minimize their cost of postage and mailing and navigate the complex rules for postal rates and eligibility.

His experience includes all major areas of postal law: business planning and compliance advice, negotiating and enforcing contracts with the USPS, investigations by the Postal Inspection Service and the Office of Inspector General, and litigation before the USPS, the Postal Regulatory Commission, and the federal courts.

He advises clients on compliance with Move Update and other address and mail preparation requirements; nonprofit eligibility rules; and other content restrictions.

He represents mailers in revenue deficiency and False Claims Act investigations, litigation and appeals involving rates, classifications, mailability, and organizational eligibility.

He has been first-chair counsel for associations of mailers in more than 50 trials, rulemakings and other cases before the Postal Regulatory Commission and its predecessor, the Postal Rate Commission.

He also has extensive experience in telecom, railroad and petroleum pipeline regulation, and has tried several dozen rate cases before the Federal Communications Commission, the Federal Energy Regulatory Commission, the Interstate Commerce Commission, the Surface Transportation Board, and state public utility commissions.

Mr. Levy has been counsel of record in 25 reported cases in the U.S. Courts of Appeals.

He has testified before Congress and drafted amendments to the postal laws that preserved nonprofit rates, and is involved in current efforts to provide legislative relief for the USPS.
