Diane Hertz is a partner in the firm’s Antitrust and Trade Regulation Group. Her practice involves litigation and counseling related to general commercial and contract disputes, business tort disputes, bankruptcy-related litigation, manufacturer-distributor relationships, distribution and trade regulations issues, products liability, and intellectual property. She has tried numerous cases and appeared before a variety of state and federal courts, as well as before arbitration panels. In the franchise and distribution area, she represents numerous manufacturers and distributors on various matters, including termination and non-renewal disputes, and market representation matters.

Recently, Diane was among the lead lawyers in connection with the Deepwater Horizon blowout in the Gulf of Mexico, defending the nonoperating investors in the Macondo oil well against claims for damages asserted by tens of thousands of private parties and by federal and state governments. Among other things, Diane took more than 25 depositions in both the U.S. and abroad, including those of numerous high-level BP executives and the engineers who designed the Macondo well. Claims asserted included damages under the Oil Spill Pollution Act, the Clean Water Act, admiralty and maritime law, and state and statutory common laws.
