Dustin P. Stevens practices in Holland & Knight's Central Florida Real Estate Group in Orlando, focusing in the area of retail real estate, real estate finance and land use.
Mr. Stevens handles complex real estate transactions, including acquisitions, dispositions and development of shopping centers, apartment complexes, single-family residential developments, retail outparcels and raw land. He has extensive experience in the continued representation of a large national retail pharmacy chain and a large national retail financial institution in the acquisition of shopping center outparcels and inline space, as well as free-standing locations. His practice includes drafting and negotiating purchase agreements, closing documents and leasing documents, reviewing due diligence materials, including title and survey, leases and management agreements, and resolving site development issues related to access, utilities, governmental approvals and environmental remediation.
Mr. Stevens represents commercial lenders and borrowers in mortgage loan transactions, drafting and negotiating loan documents, reviewing due diligence materials and coordinating closings. He assisted in the workout and ultimate foreclosure of a 7,000-acre mixed-use development of regional impact, conducting due diligence review of the loan, title and governmental documents, and preparing loan and closing documents. He has drafted and negotiated loan documents, and conducted loan and title document due diligence review on behalf of lenders pursuant to numerous secured loan workout transactions, including cross-collateralized, cross-defaulted and defaulted loans involving multiple in-place office leases.
Mr. Stevens has particular experience in multisite, multistate financing and acquisition transactions, having coordinated and conducted due diligence review and document preparation for the extension of financing to a chain of coastal marinas, the acquisition of a large national restaurant chain and the potential acquisition of multiple single-family subdivisions, among others.
Mr. Stevens researches the applicability of zoning, land use and other local governmental controls and ordinances on behalf of private landowners, as well as on behalf of local governments, in order to determine the permissibility of a number of developments and uses in various zoning classifications. He has also researched and worked with local governments in order to determine the status and availability of entitlements, capacity reservations, site plan approvals and other development rights on behalf of clients seeking to develop or finance large retail and hotel developments.
While in law school, Mr. Stevens served as a Federal Judicial Intern in the United States District Court, Middle District of Florida, for the Honorable Judge Anne Conway.
