Gerald T. Hathaway is a partner in the firm’s Labor and Employment Practice Group, based in New York City. He represents domestic and international corporations of all sizes, including Fortune 500 and Global Fortune 500 companies, in major labor and employment matters. His practices includes advising on the labor and employment aspects of local, national and international corporate transactions and financial restructuring, as well as reductions in force, including Worker Adjustment and Retraining Notification Act (WARN) and Older Workers Benefit Protection Act compliance. His clients include private equity funds, major entertainment studios and networks, talent management companies and talent agencies, and companies in the real estate, logistics, luxury goods, retail and insurance industries.
Jerry counsels management on avoiding employment litigation and grievances, and represents companies in collective bargaining, arbitrations and contentious litigation, and pursuing remedies to enjoin unlawful picketing, should the need arise.
He has experience defending Equal Employment Opportunity Commission and National Labor Relations Board charges and private lawsuits, including discrimination class actions, Fair Labor Standards Act collective actions and claims related to the Americans with Disabilities Act, the Age Discrimination in Employment Act, the National Labor Relations Act, the Labor Management Relations Act, Section 1981 and Title VII.
Since 2011, Jerry has been named one of Human Resource Executive Magazine’s 100 Most Powerful Employment Attorneys in the United States, and has been listed in the International Who’s Who of Business Lawyers (Management Labour & Employment Law). He has been recognized as one of the “Best Lawyers in America” in Labor & Employment Law from 2011-2016 by Best Lawyer, and has been listed in Who’s Who in American Law for more than 20 years. Jerry is rated "AV Preeminent" by Martindale Hubbell, the highest peer rating in both legal ability and ethical standards. He has been elected as a Fellow of The College of Labor and Employment Lawyers, the highest recognition by one’s colleagues of sustained outstanding performance in the profession.
