Hanna M. Fox

HANNA FOX is a Member of the Firm in the Health Care and Life Sciences and Litigation practices, in the New York office of Epstein Becker Green, and serves as co-leader of the firm’s Government Enforcement Service Team. She represents various health care clients, including health care systems, hospitals, long-term care facilities, medical device manufacturers, and other health care businesses.

Ms. Fox:

Represents clients in litigation, internal investigations, and governmental and regulatory investigations
Advises clients on compliance with state and federal health care laws and regulations
Provides representation to corporations and individuals in matters involving a wide range of subject areas, including the False Claims Act, Medicare and Medicaid fraud and abuse issues, "Stark" self-referral laws, audits by governmental and private insurers, physician licensure, and research misconduct
Counsels clients on forming accountable care organizations and participation in the Medicare Shared Savings Program, and on structuring relationships among related entities and hospital physician arrangements
Advises health care providers on corporate governance issues and the development and implementation of compliance programs

Prior to joining the firm, Ms. Fox was an attorney in the litigation practice of an Am Law 100 firm, where she represented health care provider clients. Previously, she served as a litigator with South Brooklyn Legal Services.

Ms. Fox is a co-founder and board member of Willie Mae Rock Camp for Girls, a nonprofit music and mentoring program that empowers girls and women through music education, volunteerism, and other activities that foster self-respect, leadership, critical thinking, and collaboration.

Representative Matters

Represented a New York area health care provider in connection with a range of matters, including the remediation of its compliance program, assessment of physician arrangements, self-reporting to the U.S. Department of Health and Human Services' Office of Inspector General ("OIG") and the New York State Office of Medicaid Inspector General ("OMIG"), and an internal investigation in connection with allegations of health care fraud and public corruption
Provided representation to a diagnostic and treatment center challenging the results of an audit by OMIG
Represented a former employee of a major research institute in connection with allegations of research misconduct and health care fraud
Represented a health care provider in the implementation of a Corporate Integrity Agreement imposed as part of settlement of a qui tam action based on allegations of Medicaid fraud
Assisted a New York area physician group in becoming one of the first accountable care organizations eligible to participate in the Medicare Shared Savings Program
Provided representation to a not-for-profit day care center in connection with a variety of licensure and regulatory matters.
