J. Patrick Kennedy

J. Patrick Kennedy is senior counsel in the Boston Office of Seyfarth Shaw LLP and a member of the Consumer Financial Services Litigation practice group. His practice over the past decade plus has focused on representing national banks, federal savings banks, state chartered banks, quasi-government entities, alternative lenders and mortgage servicing companies in litigated disputes before courts and government agencies. He has particular experience representing financial institutions in lender liability, predatory lending, mortgage servicing, U.C.C., check fraud, bankruptcy, real estate and bank operations disputes. As a result of the "subprime" mortgage crisis, he has represented a number of large national and regional financial institutions in defending TILA, FDCPA, FCRA, RESPA, TCPA and other mortgage servicing claims in individual cases. Mr. Kennedy has also defended several cases that were filed as class action lawsuits challenging the legality of a bank's products or services having substantial impact due to the scope and amount of relief sought by the plaintiffs. He has also counseled and represented banks and other types of entities in responding to data breach intrusions.

Mr. Kennedy also has substantial experience representing clients in other types of litigated disputes. In particular, he has represented clients in high stakes commercial cases and real estate cases involving boundary disputes and restrictive covenants. He also has significant experience representing a wide range of clients, including technology companies, Internet and telecommunications companies, hospitals and other health care providers, railroads and other transportation companies, medical equipment manufacturers, and insurance companies in commercial and intellectual property litigation. Types of matters include breach of contract, breach of fiduciary duty, general business litigation, personal injury cases, business torts, patent infringement and inventorship disputes, unfair competition claims, employment actions and antitrust cases. Mr. Kennedy has also advised companies involved in corporate transactions regarding compliance with the Hart-Scott-Rodino Antitrust Improvements Act of 1976, and has defended second requests and other information requests issued by government regulators. He has also represented companies and individuals in employment disputes, and has litigated cases involving non-competition and non-solicitation agreements, breach of employment agreements, age discrimination and Massachusetts Wage Act claims.

Mr. Kennedy has been recognized by his peers as a preeminent litigator and has been selected for inclusion in the Super Lawyers list for business litigation published by New England Super Lawyers magazine every year since 2007. During law school, he was an editor of the Vermont Law Review and had his note published. Immediately following law school and prior to private practice, Mr. Kennedy served a one year term as a law clerk to the Honorable Robert E. Cowen, Circuit Judge, at the United States Court of Appeals for the Third Circuit. Mr. Kennedy is very active in his local community and currently serves as the Chairman of the Town of Cohasset, Massachusetts Conservation Commission. Before attending law school, he was a commercial loan and real estate officer with lending authority at a large regional bank in the Boston area for four years.
