James P. Thomas focuses his practice on labor and employment counseling and litigation. He has represented employers in jury and non-jury trials in federal and state courts and proceedings before the National Labor Relations Board, Equal Employment Opportunity Commission, Occupational Safety and Health Review Commission, Pennsylvania Human Relations Commission and other administrative agencies in claims regarding discrimination and harassment, wage and hour, wrongful discharge, and the National Labor Relations Act and Family Medical Leave Act.
Jim has experience in traditional labor relations, such as advising employers about maintaining a union-free work environment, advising about collective bargaining agreements and strategies, and serving as an employer spokesperson in collective bargaining. He has also served as the employer’s advocate in labor-arbitration cases.
In employment law, Jim has counseled clients on employee discipline and termination, severance agreements, wage and hour matters, employment contracts and handbooks, non-compete agreements and issues, drug and alcohol policies, and independent contractor compliance. He has also advised employers regarding OSHA matters, such as defending clients before the Occupational Safety and Health Review Commission, negotiating on behalf of clients with OSHA on citations, counseling employers on health and safety issues, and defending employers against claims of retaliation under OSHA.
