Jessica Kastin has extensive experience representing employers with respect to issues arising under the National Labor Relations Act, including union elections and representation proceedings, unfair labor practice charges, collective bargaining, grievance and arbitration proceedings, and labor issues arising in the contexts of corporate mergers and acquisitions and the bankruptcy of unionized employers. She also has experience counseling employers on a broad range of employment issues such as reductions in force, WARN Act compliance, enforcement of non-competes, implementation of employment policies, New York State Labor Law compliance, and negotiation of employment and separation agreements.
Examples of Jessica's recent experience include serving as labor counsel to debtors in various high profile bankruptcies under Chapter 11 and Chapter 9, which included rejection of collective bargaining agreements and modification of retiree benefits under sections 1113 and 1114 of the bankruptcy code and negotiating with various unions for modified, lower cost labor contracts; representing employers in various industries in grievance arbitrations and in enjoining unlawful union activity under both the NLRA and the RLA; and representing employers in various industries in union organizing drives, NLRB elections, and collective bargaining negotiations.
Representative clients with whom Jessica has worked include: Verizon Communications, Hostess Brands, Inc., Delphi, General Motors, The Daily Beast Company LLC, SiriusXM, Harris Corporation, and General Cable Corporation.
Jessica is a former member of the Labor & Employment Committee of the Association of the Bar of the City of New York and the Labor & Employment Section and Railway and Airline Labor Law Committee of the American Bar Association.
