Passionate about technology and informed by the eight years he spent as a software engineer, John Polito understands his clients, their business models, and their products and services. John represents companies in disputes relating to software, mobile devices, analytics and data profiling, and online content. He counsels technology and information services companies on the creation, acquisition and licensing of copyright portfolios.

John’s accomplishments include:

Securing on appeal a stay of a preliminary injunction that had issued against an online marketplace at the height of the December shopping season in a trademark infringement matter;
Obtaining a $1.3 billion jury verdict for infringement of copyrighted software, as a core member of the trial team in Oracle USA, Inc. v. SAP AG
Representing 278 employers and employer organizations concerned about the burdens that the Defense of Marriage Act imposes on employers in a Supreme Court amicus brief in United States v. Windsor.

John has worked extensively with industry experts including computer scientists, forensics specialists, economists and statisticians. John’s pro bono practice focuses on artists’ and musicians’ intellectual property issues, immigration and civil rights matters.

In 2014, John was named an “Associate to Watch” in the Daily Journal’s Top 20 California Lawyers Under 40.
