Joshua S. Roffman has been practicing OFCCP law since 2003. He focuses his practice primarily on advising and overseeing the preparation of affirmative action plans and representing clients in various matters before the Office of Federal Contract Compliance Programs (OFCCP) and the U.S. Department of Labor.
Of the dozens of desk audit submissions Joshua prepares each year, less than 5% have resulted in on-sites and, since 2008, every single one has closed without his client paying a financial remedy.
Joshua’s experience includes preparing affirmative action plans, representing government contractors before the Office of Federal Contract Compliance Programs (OFCCP) in all six OFCCP regions, preparing for and defending OFCCP audits and onsite visits in every OFCCP region, responding to OFCCP information requests, evaluating compensation disparity and pay equity claims, evaluating single entity claims, opposing OFCCP jurisdictional claims for companies without government contracts, petitioning OFCCP for separate facility exemptions, evaluating compliance with the Uniform Guidelines on Employee Selection Procedures, and facilitating the identification of Internet applicants per OFCCP regulations.
Joshua oversees the production of hundreds of affirmative action plans annually. Each plan undergoes attorney review to ensure regulatory compliance, accuracy, and strategy, anticipating the larger legal implications of the information contained in the data analyses.
Joshua also has significant experience advising clients on reductions-in-force and preparing related adverse impact analyses, and he advises clients on the preparation of OWBPA disclosures. He uses statistical and data analysis tools in other contexts specifically as they apply to employer hiring decisions, applicant tracking, promotions, terminations, diversity initiatives, and compensation practices.
In addition, Joshua also advises clients on EEO-1 and VETS-4212 reporting requirements.
He has spoken before industry liaison groups, co-authored articles published on OFCCP enforcement initiatives and regulations, and is frequently quoted on OFCCP issues. He provides employer training on the OFCCP's Internet Applicant regulations and other affirmative action plan issues. He also has conducted web seminars on preparing AAPs and desk audit submissions, the OFCCP’s systemic compensation initiative, analysis of employee selection decisions, and E-Verify for federal contractors.
Prior to working at Roffman Horvitz, Joshua worked at Littler Mendelson for nine years and at Morgan Lewis for ten years. He was the Office Managing Shareholder of Littler Mendelson’s East Coast OFCCP Group during his last two years there.
