Kathy Hohler has 30 years of experience counseling companies on all aspects of the design and operation of their employee benefit programs, including qualified and nonqualified retirement and deferred compensation plans and welfare benefit plans, such as health plans, insurance plans, cafeteria plans, VEBAs, severance plans, and fringe benefit plans.
Kathy advises clients on plan compliance matters involving tax qualification and tax exemption, coverage and nondiscrimination testing, cash balance benefits, Roth 401(k)s, 401(k) safe harbors and automatic enrollment, defined benefit plan funding and related restrictions, ERISA fiduciary responsibility and prohibited transactions, investments, reporting and disclosure, plan terminations, HIPAA, and COBRA. She assists companies in reviewing and negotiating plan service provider agreements, including investment management agreements, trustee and recordkeeper agreements, and administrative service agreements. She represents clients before the IRS and Department of Labor in connection with plan audits, determination letter applications, and the correction of compliance failures.
Kathy's representative clients include Bridgestone Americas, Lincoln Electric, NACCO, and Premier Farnell.
She is a member of the Ohio State Bar Association and the Cleveland Metropolitan Bar Association.
