Kenneth J. Ottaviano

Kenneth J. Ottaviano is co-head of the Chicago Insolvency and Restructuring practice and a member of the firm's Board of Directors. His national practice encompasses corporate bankruptcies, out-of-court workouts and restructurings and creditors’ rights matters. Ken regularly represents banks, financial institutions, lender groups and other financing sources in complex insolvency matters—which often include several types of debt and/or equity components—throughout the United States. He is well versed in asset-based and cash-flow principles, subordinated and second lien debt, equity classes and rights, intercreditor agreements and agency and participation arrangements.

Ken also represents indenture trustees, bankruptcy trustees, examiners, special servicers, borrowers and debtors-in-possession. He has extensive experience handling debtor-creditor matters including lender liability actions, bankruptcy avoidance and preference actions, local and multijurisdictional assignments for the benefit of creditors, federal and state court receivership actions, Uniform Commercial Code sales and foreclosure proceedings.

While he concentrates mainly on distressed transactions in the health care industry, Ken has experience in numerous other industries, including automotive, retail, manufacturing, distribution, commercial finance, entertainment and media, hospitality, construction, energy, vending and franchising.
