Kerry Fowler's practice focuses primarily on complex civil litigation, including matters involving product liability, toxic tort, health care, antitrust, insurance, securities, fraud and unfair business practices, contract disputes, claims arising under the Fair Credit Reporting Act (FCRA), and other business torts. She has represented clients in state and federal courts throughout the country, and in all phases of litigation, including discovery, motion practice, trial, and appeals. In particular, Kerry has substantial experience defending clients against nationwide coordinated litigation, both in federal multidistrict litigation proceedings and in various coordinated state court actions.
Kerry's recent trial experience includes defending Yamaha Motor Co. in a three-month trial against claims of product defect, failure to warn, and negligence in connection with Yamaha's off-road, side-by-side utility vehicle known as the Rhino. The trial resulted in a complete defense verdict for Yamaha. She also was a member of the trial team defending Dole Food Company in a five-month trial involving 12 Nicaraguan plaintiffs who claimed they were rendered sterile due to exposure to a pesticide while working on banana farms in Nicaragua in the 1970s.
Kerry also has a background in corporate law and governance, having spent three years prior to law school as an analyst in the legal and government affairs department for Kaufman and Broad Home Corporation.
Kerry is a member of the State Bar of California and the Association of Business Trial Lawyers.
