Kevin Noble’s practice focuses on complex employee benefit plan issues arising under ERISA, with an emphasis on fiduciary responsibility matters. He both counsels clients and represents them in litigation.
Kevin advises plan sponsors, fiduciaries, and service providers on issues important to employee benefit plans and the employers who sponsor them. This includes counseling on fiduciary responsibilities, minimization of fiduciary liability and other ERISA risks, plan governance practices, prohibited transaction analyses, employer stock contribution and management, plan asset and other plan investment issues, stable value fund management and oversight, plan fees, preemption, plan terminations, and the resolution of issues connected to legacy liabilities, including pension de-risking and retiree health solutions.
Kevin has litigated class action, multi-district, and individual claims relating to ERISA’s fiduciary duty and prohibited transaction provisions, benefit cutback disputes, termination and reduction of retiree health benefits, top hat and other executive retirement plan disputes, claim denials, plan interpretation issues, ESOP valuation challenges, and 401(k) plan employer stock claims. Kevin has also represented clients before the Labor Department and the Pension Benefit Guaranty Corporation in plan audits, investigations, and regulatory guidance projects.
Recently, Kevin represented General Motors in its decision to settle pension liabilities in transactions totaling approximately $30 billion. The transactions resulted in the largest plan termination, annuity contract purchase, and pension de-risking action in history. Previously, he had advised General Motors in the design, creation, and funding of an independent retiree health care VEBA that assumed responsibility for providing benefits to approximately 699,000 UAW retirees and dependents.
