Kristen Lejnieks's practice focuses on complex civil litigation and white-collar criminal matters. Her civil litigation practice spans a broad range of matters, including commercial disputes and class actions, with a particular focus on complex multijurisdictional and multiparty matters. Kristen's criminal defense practice extends to the representation of clients under investigation by law enforcement or grand jury as well as the conduct of internal investigations and implementation of corporate compliance programs. She works regularly on matters arising under antitrust laws, securities laws, the Foreign Corrupt Practices Act, RICO, and the False Claims Act. In the course of these cases, she has coordinated clients' defenses, including all aspects of fact discovery, motions practice, and if necessary, appellate briefing.
Kristen has a particular interest in electronic discovery and emerging issues in ediscovery. She has counseled clients on a wide range of issues related to data privacy, data storage and retention, and electronic discovery, and has conducted trainings for other Jones Day associates on these issues.
She also maintains an active pro bono practice. Kristen was a member of the team that represented the National Security Archive in its highly publicized lawsuit against the Executive Office of the president and other defendants, seeking to preserve and restore millions of missing emails from the White House. She has assisted in the drafting of a number of appellate briefs on behalf of pro se litigants, including a Third Circuit asylum petition, Sixth Circuit habeas action, and a petition for certiorari to the Supreme Court. In addition, Kristen successfully represented a Washington, D.C. homeowner in an action to recover a home that was erroneously sold at a tax sale.
