Marc A. Lackner

Marc’s practice focuses primarily on consumer finance class action litigation and enforcement matters, with a particular emphasis on mortgage, credit card and deposit banking issues, including privacy (TCPA and state call recording schemes), and National Bank Act preemption.

Marc spent 14 years with Bank of America, from 1997-2011, and, as such, has a wealth of experience in financial services litigation. While there, Marc served as Associate General Counsel, managing the Mortgage Litigation Group, which provided litigation support for that institution’s Consumer Real Estate and Legacy Asset Servicing Divisions. Most recently, he oversaw the integration of the legacy Countrywide Financial and the Bank’s litigation groups after the Bank’s 2008 acquisition of Countrywide as well as the group’s combined mortgage litigation which grew to more than 7,000 open litigation matters, more than 200 of which were class actions. In addition, Marc assisted in the management of legacy Countrywide’s shareholder, MBS securities, and rep and warranty litigation, including issues of corporate separateness and successor liability.

During his tenure, Marc also had responsibility for the Bank’s Consumer Real Estate litigation, Consumer Products (CRE, Insurance Services, Deposit Products, ATM/Debit and e-Commerce), Card, Consumer Special Assets (subprime real estate, sub-prime auto, auto lease, and manufactured housing), Dealer Financial Services (indirect auto lending), Vendor Management, Corporate Marketing and Communications, Tax, and Bank Regulatory. In 2004, he served as the Bank’s representative in its successful support of the California tort reform effort, Prop 64, as a member of the steering committee that drafted language for the state-wide initiative.
