Marc Callahan represents clients in complex disputes with other businesses, consumers, and the government. Marc’s practice focuses on class action defense, unfair business practices, false advertising, fraud, and other consumer protection claims. Marc has extensive experience litigating claims under state and federal statutes, including California’s Unfair Competition Law, the Consumers’ Legal Remedies Act, and False Advertising Law; Illinois’ Consumer Fraud Act, the federal Fair Credit Reporting Act, Credit Repair Organizations Act, and the Lanham Act. Marc has significant experience in drafting and enforcing arbitration agreements.
Recently, Marc represented Experian Information Solutions in a lawsuit against LifeLock, and obtained summary judgment establishing the client’s unfair competition claim, (Experian Information Solution, Inc v. LifeLock, Inc., 633 F.Supp.2d 1044 (C.D. Cal. 2009)), ultimately resulting in a permanent injunction in favor of Experian. Marc also represented Cellco Partnership d/b/a/ Verizon Wireless in a putative consumer class action, obtaining a dismissal on the pleadings and a published appellate opinion limiting the scope of plaintiff standing to pursue an unfair competition lawsuit (Peterson v. Cellco Partnership, 164 Cal. App. 4th 1583 (2008)). Marc has obtained numerous orders compelling individual arbitrations of putative consumer class actions.
Marc is a member of the board of directors of the Orange County Bar Foundation and is a Founding Fellow of the Society of Fellows of the Orange County Bar Foundation. Marc has also served as a delegate in the Conference of Delegates of the California Bar Association.
