Marina Blickley is a litigator in the firm's Labor and Employment Group where she focuses on management-side employment law counseling and representation. She was recognized by Virginia Super Lawyers as a "Rising Star" in 2014.
Employment & Commercial Litigation: Ms. Blickley regularly represents and defends employers against claims of employment discrimination, harassment, and retaliation before the EEOC, state agencies, and local state and federal courts. Ms. Blickley also regularly defends employers against claims of violations of wage and hour laws. She represents companies in commercial litigation matters concerning contract disputes, restrictive covenants, unfair competition, business conspiracy, misappropriation of trade secrets, and computer fraud and theft.
Ms. Blickley has experience in all aspects of litigation including drafting and responding to pleadings, motions, and discovery, taking and defending depositions, pretrial preparation and motions, and trial practice. Recently, Ms. Blickley second-chaired a jury trial in Federal District Court in a military discrimination case under USERRA resulting in a defense verdict.
Ms. Blickley is also experienced in conducting internal investigations and participating in mediations.
Employment Counseling: Ms. Blickley frequently advises clients on compliance with a variety of federal and state laws. Recently, she has worked on matters pertaining to the Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), Title VII, Section 1981 of the Civil Rights Act of 1866, Employee Retirement Income Security Act (ERISA), the Consolidated Omnibus Budget Reconciliation Act (COBRA), the Family and Medical Leave Act (FMLA), the Uniformed Services Employment and Reemployment Rights Act (USERRA), the National Labor Relations Act (NLRA), the Fair Credit Reporting Act (FCRA), and various other state and federal laws. In addition, Ms. Blickley assists clients by reviewing and revising employee handbooks and other policies and procedures including compensation practices, leave administration, and discipline/termination procedures.
Ms. Blickley regularly assists clients in drafting and negotiating various employment-related contracts including executive employment agreements, restrictive covenant agreements, and severance and release agreements. She also conducts training of supervisors and other staff regarding discrimination and harassment prevention.
