Mark Cody's practice focuses primarily on corporate bankruptcy, restructuring, distressed acquisitions, and other insolvency-related matters. He has advised debtors, lenders, large creditors, official creditors' committees, distressed investors, and other parties in large in-court and out-of-court corporate restructurings across the country.
Mark's representative chapter 11 debtor matters include: Chrysler, FLYi/Independence Air, Harry & David, Imperial Home Decor, Laidlaw, Loewen Group (n/k/a the Alderwoods Group), Metaldyne, Montgomery Ward Holding Corp., National Century Financial Enterprises, NationsRent, Performance Transportation Services, Purina Mills, Slater Steel, Tultex, and USG.
Mark also has represented the senior administrative agent in the out-of-court restructuring of Network Communications; the holder and insurer of certain general obligation debt in the chapter 9 case of Jefferson County, Alabama; the first lien mortgage lender in the Hotel 71 chapter 11 case; the administrative agent to the pre- and post-petition secured lenders in the National Equipment Services cases; the official committee of retired employees in the chapter 11 cases of Tower Automotive; the official committee of unsecured creditors in the chapter 11 cases of Mercury Finance and MobileMedia Communications; International Textile Group in the chapter 11 cases of its wholly owned subsidiary Global Safety Textiles Holdings; and a large creditor in the chapter 11 cases of Calpine Corporation.
Mark is a member of the American Bankruptcy Institute, the Turnaround Management Association, the Illinois State Bar Association, and The Chicago Bar Association.
