Mr. Casciari is a partner at Seyfarth Shaw LLP. His practice focuses on ERISA and other employee benefits litigation, and on labor and employment litigation generally, including class action litigation. Mr. Casciari represents employers, plan sponsors, plans, plan administrators, fiduciaries, and independent fiduciaries. He has substantial experience suing a federal agency on the theory that it has acted beyond its statutory authority under the Administrative Procedure Act and in violation of the Constitution.
Mr. Casciari has practiced extensively before federal and state courts and agencies. He has tried cases before federal and state judges and juries, administrative law judges, hearing officers and arbitrators. He has taken or defended hundreds of depositions. He has been lead counsel in numerous private mediations and settlement conferences. Of note is that Mr. Casciari has successfully orally argued 11 of 13 appeals in the U.S. Court of Appeals for the Seventh Circuit.
Mr. Casciari is a frequent speaker on ERISA and employee benefits, and other employment law topics, including on class actions procedure. He is a long-standing adjunct professor of trial advocacy at the Northwestern University School of Law.
