Michael J. Twomey

Michael Twomey has more than 20 years of experience as intellectual property counsel to biotechnology and life sciences companies. His practice includes client counseling in all aspects of domestic and foreign patent prosecution; patent portfolio management and development; US Patent Office post-grant proceedings, including Inter Partes Reviews, Inter Partes Reexams and Ex Parte Reexams; appeals before the US Patent Trial and Appeals Board and the Court of Appeals for the Federal Circuit; Oppositions before the European Patent Office; and US District Court patent litigation; as well as negotiation of patent licenses and the conduct of intellectual property due diligence analyses in connection with mergers, acquisitions, private equity placements and public stock offerings. Mr. Twomey also provides clients with opinions relating to issues of patent infringement and validity, and conducts clearance studies and freedom-to-operate opinions for new product development and launches.

Mr. Twomey's experience includes multiple Inter Partes and Ex Parte Reexaminations before the US Patent Office, patent litigation in the US District Courts, and multiple proceedings before the Opposition Division and Technical Board of Appeals of the European Patent Office.

Mr. Twomey has argued appeals before the United States Court of Appeals for the Federal Circuit and the Board of Patent Appeals and Interferences.

Mr. Twomey received a JD degree, cum laude, from Harvard Law School, and an AB degree, magna cum laude, in biological sciences from Harvard College, where he was elected to Phi Beta Kappa. He was a National Science Foundation Graduate Fellow in biology from 1985 through 1988, and a Graduate Fellow in the Department of Biological Sciences at Stanford University from 1985 to 1990, where he conducted research in population genetics relating to the evolution of mutation and recombination rates.

Mr. Twomey is admitted to practice in the Commonwealth of Massachusetts, the United States District Court for the District of Massachusetts, the United States Court of Appeals for the Federal Circuit and is registered to practice before the US Patent and Trademark Office.

Mr. Twomey is a member of the American Intellectual Property Law Association and the Boston Patent Law Association.

Prior to joining the firm, Mr. Twomey was associated with Testa, Hurwitz & Thibeault, LLC and Wolf, Greenfield & Sacks, P.C.
