Michelle Park Chiu

Michelle Park Chiu is an associate in Morgan Lewis's Litigation Practice. Ms. Chiu represents corporate and individual clients in a variety of complex litigation matters, including civil and criminal antitrust litigation, white collar and securities litigation matters, arbitrations, Foreign Corrupt Practices Act investigations, corporate internal investigations, and congressional hearings.

Ms. Chiu's significant representations include:

Representation of an Asian technology company in a multidistrict antitrust litigation, including defense of the client against class action plaintiffs, direct action plaintiffs, and litigation brought by multiple state attorney generals.
Representation of an international securities clearing firm in a FINRA arbitration.
Representation of a Fortune 500 semiconductor process control and yield management solution corporation in derivative and class action civil litigation arising from investigations by the SEC and U.S. Attorney's office regarding allegations of stock options backdating.
Representation of a hedge fund manager in a SEC investigation regarding allegations of securities fraud.
Representation of an airline corporation in an investigation by the Department of Justice regarding price fixing allegations.

Complementing her antitrust and securities practice, Ms. Chiu has represented clients in other types of litigation, including:

Representation of a California healthcare provider in an arbitration regarding breach of contract claims; representation resulted in arbitration finding in favor of client on all claims.
Representing employers in obtaining civil workplace restraining orders on behalf of their employees in California.
Representation of petitioners in Bridge v. Phoenix Bond & Indemnity Co., No. 07-210, before the United States Supreme Court, on the issue of whether reliance is a required element of a RICO claim predicated on mail fraud.
Representation of a retail company in an appeal of a labor and employment matter in California State Court; representation resulted in reversal of entire punitive damages award and remand on compensatory damages.

In addition, Ms. Chiu maintains an active pro bono practice, having represented a detained refugee in removal proceedings, which resulted in a dismissal of all immigration charges and release of the client. She also has represented a client in applying for a U-Visa, and currently serves as the vice-chair of the San Francisco Office Pro Bono Committee.

Ms. Chiu began in Morgan Lewis's Washington, D.C. office before transferring to the San Francisco office.

Ms. Chiu received her LL.M. in international and comparative law and her J.D. from the dual-degree program at Duke University School of Law in 2006. While in law school, she was a member of the moot court board and a lead editor for the Duke Journal of Comparative and International Law. Ms. Chiu received her B.A., summa cum laude, in Hispanic and continental European literature from Boston University in 2003, where she was a member of Phi Beta Kappa.

Ms. Chiu is admitted to practice in California and the District of Columbia and before the U.S. District Court for the Northern District of California.
