Monica A. Neuman

Monica Neuman is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Boston office. She focuses her practice on complex transactions and regulatory compliance matters affecting companies and institutions in the health care industry. Monica represents a wide range of clients, including tax-exempt hospitals and health systems, academic medical centers, physician group practices, medical device and pharmaceutical companies, as well as a variety of other health care organizations.

Monica provides transactional representation to clients in connection with mergers and acquisitions, joint ventures and strategic affiliations. These transactions include asset transfers, stock transactions, merger transactions and other affiliation transactions. She has developed the knowledge and experience to successfully negotiate, document and close health industry transactions. Monica also counsels clients regarding general business transactions and the development and negotiation of complex contractual arrangements (including structuring and drafting Stark and anti-kickback compliant physician arrangements).

Monica’s regulatory practice is focused on developing comprehensive operational and compliance programs for human subject, animal and bench research. This includes developing enterprise-wide policies and procedures to address individual and institutional conflict of interest, research misconduct as well as other issues inherent to an institution’s research program infrastructure. Monica also develops guidelines for the appropriate relationships between providers and industry.

Monica advises clients on the legal issues impacting translational research and personalized medicine, including emerging issues in the future, unspecified use of biospecimens and data. In addition, she actively advises clients on data sharing architecture, data and biospecimen collection and repositories, and data sharing collaborations and partnerships.

Monica was recognized by Chambers USA as an Up and Coming Healthcare Attorney (2013-2014). Chambers USA notably mentions her as “continu[ing] to build on her reputation in the Massachusetts healthcare space with her representation of a broad span of clients, including academic medical centers, pharmaceutical and medical device companies, and tax-exempt hospitals in research compliance and transactional matters.” Additionally, the Boston Business Journal featured Monica as an Emerging Leader and ‘at the forefront’ of evolving health care law.

Monica enjoys serving as a member of the firm’s Diversity / Inclusion Committee and the Firm’s Racial & Ethnic Diversity & Inclusion Sub-Committee. She has also been appointed to the Boston Children’s Hospital Trust Latino Advisory Committee. She also serves on the Firm's national coordinating Committee for pro bono activities, where she directs and manages the Firm’s pro bono and community service efforts. Her pro bono practice focuses on advocating on behalf of children with special education needs and she was a recipient of the Inaugural American Health Lawyers Association Pro Bono Champion Award for 2012 and the John Edward Smith Child Advocacy Award in 2002. She regularly receives special education cases from the Medical Legal Partnership for Children and the Children’s Law Center of Massachusetts.
