Nancy MacKimm defends clients in environmental and toxic tort litigation relating to groundwater contamination, air emissions, vapor intrusion, damage to natural resources, and other consequences of industrial activity. Nancy has substantial experience in the defense of government enforcement actions and citizen suits; litigation related to liability for cleanup costs, property damage, and personal injuries; and insurance disputes relating to such liabilities. She advises clients with respect to environmental criminal investigations and the resolution of environmental liabilities in bankruptcy proceedings.
Nancy's recent work includes the defense in New York state court of hundreds of personal injury, medical monitoring, and property damage claims relating to vapor intrusion, historic air emissions, and groundwater contamination; the defense of a medical monitoring class action brought on behalf of children living in a heavily industrialized area of the Midwest; and the defense of cancer claims allegedly arising out of oil exploration and production activities in Ecuador. Representative clients include Bridgestone, Chevron, Dole Food Company, and IBM.
Nancy is Partner-in-Charge of the Houston Office. She is a director of the World Affairs Council of Houston, Co-Chair of the Law Initiative Campaign for United Way of Greater Houston (2013-2014), and a member of the United Way's Alexis de Tocqueville Society.
