Noah C. Graubart

Noah Graubart has an international practice specializing in patent infringement litigation and other areas of intellectual property. Mr. Graubart regularly represents clients at the trial level as well as in appellate matters, arguing or briefing cases in the U.S. Courts of Appeals, including at the Federal Circuit.

Mr. Graubart assists clients from the U.S. and around the world with a variety of cases in the district courts, the courts of appeals, and the U.S. International Trade Commission. Mr. Graubart regularly represents both plaintiffs and defendants, and he represents clients against both competitors and non-practicing entities. Mr. Graubart’s patent litigation and counseling practice includes experience with a diverse range of technologies, including telecommunications software, wireless networking, optical networking, computer interfaces, semiconductor fabrication methods, veterinary pesticides, and docking speaker systems.

Mr. Graubart strives to accomplish his clients’ specific goals, seeking victory as that is defined for a given client and case. Some matters must be litigated through trial and appeal, while others can be concluded quickly and favorably with creative resolutions. Thus, Mr. Graubart has successfully obtained pre-discovery dismissals for defendants in patent infringement and false marking cases, temporary restraining orders and preliminary injunctions for plaintiffs in trademark and copyright matters, advantageous settlements or dismissals for plaintiffs and defendants after securing favorable claim construction rulings, as well as complete victories at summary judgment, at trial, or on appeal.

Mr. Graubart serves as the Atlanta office’s Pro Bono Coordinator and is actively involved in numerous pro bono causes. Mr. Graubart assisted in obtaining from the Supreme Court of Virginia a reversal and new sentencing hearing for a client facing a death sentence. He serves on the Board of Directors for the Texas Defender Service and was previously on the Board of Directors’ Advisory Committee for the Atlanta Legal Aid Society.

Prior to joining the firm, Mr. Graubart served as a law clerk for the Honorable Jerry E. Smith of the United States Court of Appeals for the Fifth Circuit.

Mr. Graubart lives in Decatur, Georgia, with his wife of ten years, Emily, and their three children.
