Joey Burby is a litigation partner in the firm’s Atlanta office. He is a former federal and state prosecutor who focuses his practice on white collar criminal matters, corporate internal investigations, and complex civil litigation.
Mr. Burby regularly defends companies and individuals in criminal investigations by the Department of Justice and U.S. Attorney’s Offices across the country, as well as in regulatory investigations and civil enforcement actions by agencies such as the Securities and Exchange Commission, the Food and Drug Administration, and the Department of Health and Human Services' Office of Inspector General. He is also frequently engaged by corporations, boards of directors, and their committees to conduct internal investigations into allegations of employee misconduct and to counsel them on disclosure and compliance issues. Mr. Burby has successfully handled cases involving health care fraud, securities fraud, antitrust violations, the False Claims Act, tax fraud, RICO violations, the Foreign Corrupt Practices Act, bribery and campaign finance violations, immigration offenses, money laundering, mortgage fraud, and export control violations, among other subjects.
Prior to joining the firm, Mr. Burby served for nearly five years as an Assistant U.S. Attorney for the Northern District of Georgia. As a federal prosecutor, Mr. Burby investigated and prosecuted a wide range of offenses but focused principally on public corruption and government fraud. He successfully tried numerous cases, including a capital case in which the jury returned a death sentence, and also briefed and argued cases before the Eleventh Circuit Court of Appeals. He was involved in several high-profile cases including, most notably, the successful prosecution of Centennial Olympic Park bomber Eric Rudolph. Mr. Burby received The John Marshall Award, one of the Justice Department’s highest honors, for his work on the Rudolph case.
Prior to his tenure with the Justice Department, Mr. Burby was in private practice at another major Atlanta law firm. His practice there focused on antitrust litigation and white collar criminal matters. Earlier in his career, Mr. Burby served as an Assistant District Attorney with the Fulton County District Attorney’s Office in Atlanta, where he successfully tried numerous homicide and other high profile felony cases.
Mr. Burby is a frequent speaker at many business crime-related conferences and seminars sponsored by, among others, the American Bar Association, the Practicing Law Institute, and the Georgia Institute of Continuing Legal Education. Mr. Burby was recently profiled in Corporate Crime Reporter, a weekly print newsletter focusing on corporate crime and corruption that regularly features interviews with leading white collar practitioners. He was also recognized as a Georgia Rising Star from 2007-2011 in the area of White Collar Criminal Defense by Super Lawyers magazine.
