Rebecca Hagenson

Rebecca Hagenson's practice focuses on complex civil litigation. She works primarily in the area of securities litigation.

Rebecca represented Bayerische Hypo-Und Vereinsbank AG ("HVB"), the second largest bank in Germany, in connection with federal RICO and common-law fraud claims brought by a California corporation that promoted and arranged certain tax shelter transactions disallowed by the IRS. Rebecca helped achieve summary dismissal of all claims, which came after discovery and motion practice, two weeks prior to the start of trial.

Rebecca also represented Fairfax Financial Holdings Limited, a Canadian insurance holding company, in a New Jersey action arising out of a short-selling attack on Fairfax and its operating subsidiaries by a group of hedge funds and their operatives in collusion with certain purportedly independent securities analysts. Fairfax and its principal property and casualty insurance subsidiary have asserted claims under New Jersey's RICO statute and New Jersey common law seeking $6 billion in damages for the harm they suffered as a result of the attack.

Her recent representations primarily involve disputes arising out of the housing market crisis, wherein she is advising purchasers of asset-backed securities and collateralized debt obligations as they seek redress for the misrepresentations and breaches of warranties written into those financial products by their originators and sponsors. She recently finished a secondment assisting a foreign bank in connection with CDO-related claims.

Rebecca has also handled a number of smaller matters involving disputes arising out of commercial contracts, business torts. In addition, Rebecca has represented several clients seeking child support through the firm’s pro bono program.
