Robert A. Hammeke

Robert A. Hammeke is a member of Dentons' Litigation and Dispute Resolution practice. He has more than 15 years of experience primarily in the financial services sector, across all aspects of commercial loan enforcement and creditor/debtor relationships. He regularly represents commercial creditors, including community, regional and national banks and other financial institutions, collateralized mortgage-backed securities (CMBS) and non-CMBS special servicers and distressed debt purchasers as they enforce, restructure or work out commercial lending relationships.

Bob has particular experience with all aspects of state and federal court receiverships, including representing creditor interests and receivers utilizing receiverships to preserve, maximize the value of and sell collateral and related business interests in order to maximize loan recovery. He has represented creditor interests in all aspects of non-bankruptcy loan enforcements, including pre-judgment and post-judgment replevins and attachments, real and personal property foreclosures, receiverships, garnishments, executions, unlawful detainers and foreclosure, receiver and execution sales. He also regularly defends secured creditors against lender liability claims and debtor defenses to loan obligations.

Bob represents secured and unsecured creditors and the varied interested parties in bankruptcy cases and proceedings, including relating to first-day motions; motions seeking to protect cash and other collateral and relating to the use and sale of collateral; claims and priority disputes; motions for relief from the automatic stay, adequate protection or to dismiss bankruptcy cases; executory contract issues; plan confirmation issues, including cram-down; single asset real estate issues; and defending preference, fraudulent transfer and other bankruptcy avoidance proceedings.
