Robert M. Brochin

Robert M. Brochin is a partner in Morgan Lewis's Litigation Practice and a co-leader of the Commercial Litigation Practice. His 30-year career as a trial lawyer representing the firm’s corporate clients has spanned a wide spectrum of complex business, commercial, and regulatory matters. Most recently, Mr. Brochin served as national defense counsel for several financial services clients embroiled in a variety of claims, including a series of complex, multidistrict putative class actions in state and federal courts across the United States, coupled with investigations and lawsuits brought by multiple states’ Attorneys General.

As a leader of multijurisdictional and multi-party litigation teams, Mr. Brochin leverages decades of trial court experience and complex case management skills, as well as technical insight into business law and the regulatory process. His advocacy, procedural, and negotiating skills have been recognized with numerous accolades. He has been named a “Most Effective Lawyer” by American Lawyer Media, and is praised for his courtroom performance by Chambers USA.

The breadth and versatility of Mr. Brochin’s career has encompassed the representation of corporate clients in a wide range of complex commercial matters involving real estate, financial institutions, breach-of-contract disputes, and business torts relating to unfair competition and misappropriation of trade secrets. Mr. Brochin also has experience defending corporations against claims under the federal and state False Claims Acts.

Mr. Brochin’s passion for public law and human rights issues, and his insight into the business regulatory process that invest his commercial and business litigation counsel, are rooted in a decade of high-level public service to Florida’s Executive Branch. This distinguished service, first as Deputy Counsel to the Florida governor, then as Florida Inspector General (the executive branch's watchdog over about a dozen state agencies) and as an appointed member of the 1998 Florida Constitution Revision Commission, placed Mr. Brochin at the nexus of Florida business issues and public law. Additionally, Mr. Brochin was appointed Counsel to the State of Florida’s Emergency Financial Oversight Board, a legal structure with no precedent that was charged with helping the City of Miami recover from a declaration of a financial emergency.

Mr. Brochin also participated, at the governor’s request, in framing proposals to reform Florida’s capital punishment legal procedures, as well as a successful Constitutional amendment prioritizing quality public education. Mr. Brochin’s insight into Florida public law and business regulation is likewise informed by his writing and participation in framing the Florida False Claims Act of 1991, the Florida Civil Rights Act of 1992, and Section 702.10 of the Florida Statutes, which provides for alternative foreclosure procedures.

Mr. Brochin was an ad hoc member of the Committee on Rules and Procedures for the U.S. District Court for the Southern District of Florida. He is admitted to practice in Florida and before the U.S. Courts of Appeals for the First, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, and Eleventh Circuits; the U.S. District Courts for the Southern, Middle, and Northern Districts of Florida; the U.S. District Court for the Southern District of Illinois; and the U.S. District Court for the Western District of Michigan.
