Robert M. Kline is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm’s Miami office. He is a member of McDemott’s Trial Practice Group, and his specialty is complex litigation, with a focus on health care law, class action defense in both state and federal courts, noncompetition agreements, and Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA).

Representative Experience

Prevailed at trial in federal court on behalf of Fortune 20 telecommunications company by obtaining permanent injunction enforcing restrictive covenants and noncompetition agreement against high-level executive who attempted to work for a competitor.
Defeated class certification of putative class of health care providers that alleged HMO and health insurer violated Florida’s prompt pay statutes; then prevailed against named plaintiff on summary judgment.
Obtained complete dismissal of ERISA claims against health insurer by providers of manipulations under anesthesia, and successfully defended against the appeal before the 11th Circuit Court of Appeals.
Defeated class certification of putative class of chiropractors who alleged that health insurer violated Florida statute prohibiting insurance plan discrimination.
Obtained complete victory in breach of contract action by home health care management company against provider of home health care services.
Defeated emergency motion for preliminary injunction by provider of durable medical goods against health maintenance organization.
Negotiated favorable resolution of shareholder dispute related to valuation and redemption of ownership interests in maxillofacial surgery practice.
