Robert W. Hayes

Bob is a member in the firm's Commercial Litigation Practice Group and focuses his practice on litigation concerning the propriety of business conduct, including actions involving antitrust, fraud, misrepresentation, trademark and copyright infringement and unfair competition (under both the Lanham Act and state law) claims. He also regularly handles patent infringement, complex breach of contract and product liability actions. In addition to his litigation practice, Bob counsels clients as to antitrust and other compliance issues.

Bob has significant experience in the sports and entertainment industry, representing professional sports franchises, professional athletes, concert promoters, owners and operators of stadiums, arenas and amphitheaters, musicians, professional photographers and musical instrument retailers. Bob also serves as national coordinating counsel for product liability claims on behalf of a consumer product manufacturer. His clients furthermore include telecommunications and Internet companies.

Bob has tried more than 50 substantial cases to verdict, judgment or arbitration award. He has obtained verdicts or awards in excess of $2 million on multiple occasions, including in three matters in which the value of the recovery exceeded $25 million. Bob has also successfully defended at trial several matters in which more than $1 million in damages were demanded. He has argued numerous appeals involving complex substantive issues, including before the Supreme Court of Pennsylvania and United States Court of Appeals for the 3rd Circuit.

Bob regularly serves as lead counsel in the defense of antitrust, securities fraud, mass tort, consumer fraud, banking and insurance class actions and has defended derivative claims in various jurisdictions. Those representations have included claims against, inter alia, biotechnology companies, agricultural entities, manufacturers and distributors of medical devices and consumer products, banks, insurance companies, financial services firms and software developers. Bob has tried to resolution in the Delaware Chancery Court directors’ and officers’ claims to be indemnified for the attorneys’ fees and costs incurred in defending litigation allegedly arising out of the discharge of their corporate responsibilities and argued corporate law issues in the Supreme Court of Delaware.

Recently, Bob lead a trial team that obtained a $3.25 million verdict, including $1 million in punitive damages, against a company that was found to have unfairly competed by pursuing baseless patent infringement claims against our client. Bob obtained judgment as a matter of law at trial upon RICO claims asserted against a client on the basis of her alleged participation in her husband’s fraudulent international adoption scheme and a defense verdict upon all remaining state law claims other than for the return of minimal sums received from the husband.

Other notable matters include: arguing class action issues before an en banc panel of the United States Court of Appeals for the 3rd Circuit in one of the first appeals under Federal Rule of Civil Procedure 23(f); and representing a promoter in testifying before the Antitrust Subcommittee of the Senate Judiciary Committee concerning the Ticketmaster/Live Nation merger.

Bob graduated magna cum laude from Villanova University School of Law, where he was elected to the Order of the Coif and was a member of the Law Review, and earned his undergraduate degree, with honors, from St. Joseph’s University.
