Rose Jones

is King & Spalding’s Director of e-Discovery Project Management and Client Services. Her practice focuses on e-discovery management including the development of standard protocols for the various phases of the discovery process. She is a senior member of King & Spalding’s Discovery Center and acts as National Discovery Counsel for large corporations. Ms. Jones provides advice and counsel prior to beginning document review to limit the scope and cost of the document review, including protocols/best practices and vendor selection and contract negotiations, as well as early case assessment, key word development and validation. She works closely with vendors to ensure the consistency and quality of the document review process and work product by developing customized work flow and document organization. Using standard privilege review and logging protocols, Ms. Jones manages the preparation of defensible and cost-effective privilege logs.

Ms. Jones has over a decade of experience over the entire spectrum of the e-discovery process, from document collection to the defense of privilege logs, and all steps in between. She has managed the e-discovery process in a wide variety of matters, including pharmaceutical, environmental, product liability, mass tort, and intellectual property litigation, as well as various internal investigations and governmental investigations, including Congressional Committees, the Securities and Exchange Commission (SEC), the National Highway Traffic Safety Administration (NHTSA), various State Attorneys General, the US Attorney's Office for the Southern District of New York (SDNY), the Federal Trade Commission (FTC), United States Department of Justice (US DOJ), Office of the Comptroller of the Currency (OCC), and the Royal Canadian Mounted Police (RCMP).

Ms. Jones received her J.D. degree from Georgia State College of Law in 2002. She graduated, with honors, from Georgia Institute of Technology in 1999 with a B.S. degree in Industrial & Systems Engineering. Ms. Jones is admitted to practice in Georgia and the United States Patent and Trademark Office. She is a member of the State Bar of Georgia. Ms. Jones received the Pro Bono Service Award in 2006.

Publications

“Sanctions for E-Discovery Violations: By the Numbers,” co-author with Dan H. Willoughby, Jr. and Gregory R. Antine, Duke Law Journal, Volume 60, Number 3 (December 2010), surveying 400 federal court opinions involving motions for sanctions relating to the discovery of electronically stored information and analyzed for date, court, type of case, sanctioning authority, sanctioned party, sanctioned misconduct, sanction type, sanctions to counsel and protections provided by Federal Rule of Civil Procedure 37(e). The article was cited by Magistrate Judge Grimm in Victor Stanley, Inc. v. Creative Pipe, Inc., 250 FRD 251 (D. Md. 2010) as evidence of the lack of uniform national standards governing the duty to preserve potentially relevant evidence, the level of culpability needed to justify sanctions, and the appropriate sanctions for varying levels of misconduct.

Speaking Engagements

Ms. Jones is a founding member of the Atlanta Chapter of the ESI Roundtable which is a joint venture of distinguished local judges and lawyers who volunteer their time and resources to lead the Atlanta legal and business communities through education, panel discussions and targeted networking on relevant issues and trends in the areas of Electronically Stored Information (ESI) and Electronic Discovery that affect and have transformed modern legal practice and the way businesses operate in the digital age of ESI. On January 15, she participated in a panel discussion on FRCP e-Discovery Amendments and Proportionality, on March 15 she presented a CLE entitled “Managing e-Discovery Costs Through Cooperation,” on May 17 she presented a CLE entitled “Technology Assisted Review,” and on August 14, 2013 at the ESIRT: Hands-On Training & CLE Event, she presented a CLE, “Searching for your CAR?”

On April 4th, Ms. Jones co-presented with John Tucker (King & Spalding) a CLE on “Ethical Challenges of E-Discovery” at Kroll Ontrack’s Certification Workshop in Atlanta.

Ms. Jones also participated in the 2013 E-Discovery Project Management Summit held in Pittsburgh on May 22, 2013, where she participated on a panel, “Cross-Border Discovery – Strategies for Preparedness,” with Connor Crowley (Crowley Law Office), Frank Maas (Magistrate Judge, SDNY), and moderated by Monique Altheim (Altheim Law Office). She also participated on a panel, “Rapid Fire Quick Tips,” with Elizabeth Campbell (Locke Lord) moderated, with Jennifer Mason (Mintzer, Sarowitz). Last, Ms. Jones moderated a panel, “What In-House Counsel Wishes you Knew,” with panelists James English (Fed Ex) and Michael Higginbotham (Fed Ex).

On August 20, 2013, Ms. Jones participated at the International Legal Technology Association (ILTA) Conference in Las Vegas on a panel, “E-Discovery Price Predictability: An Ongoing Debate,” with Jennifer Hamilton (John Deere), Gene Eames (Pfizer) and Kitz Goetz (Qualcomm), moderated by Eric Lieber (Toyota).

On August 29, 2013, Ms. Jones presented a CLE, “How to Be Successful in E-Discovery,” at the WiE Atlanta Chapter meeting.
