Samuel R. Miller

SAMUEL R. MILLER is senior counsel in the firm’s San Francisco office. Mr. Miller focuses his litigation practice in the areas of antitrust, intellectual property, securities law, complex civil litigation and white-collar criminal matters. His clients include major companies in the computer and consumer electronics industries. In 1994, he was recruited by the Antitrust Division to serve as lead counsel in the first Section 2 monopolization case brought by the Department of Justice against Microsoft Corporation.

Monopolization Case Experience

Mr. Miller has extensive experience in handling monopolization cases. He served as lead counsel in the first Department of Justice case of U.S. v. Microsoft Corp. He has represented a number of companies in matters relating to the conduct of a dominant firm.

Price-Fixing Litigation Experience

Mr. Miller also represents major national and international companies in price-fixing government investigations and private class actions in both federal and state courts.

Standard-Settings and Other Antitrust and Unfair Competition Experience

Mr. Miller also has extensive experience counseling companies with respect to antitrust issues involving Section 1, Section 2, and the Robinson-Patman Act. He also regularly represents companies in unfair competition and unfair business practice litigation in federal and state court. Mr. Miller was involved in the creation of a standard-setting organization involving major semiconductor and consumer electronics companies. He was invited to testify with the Federal Trade Commission in hearings related to the antitrust issues involved in standard setting.

Other Complex Commercial Litigation

Mr. Miller has experience in a wide variety of other types of litigation, including representing officers and directors in securities litigation and in SEC investigations. He also has experience in real estate, environmental, contract disputes, complex commercial litigation, and intellectual property matters, representing clients both as a plaintiff and as a defendant.

Latin American Experience

Mr. Miller has experience advising Latin American clients on various antitrust issues. He also has experience with commercial transactions and loans in Latin America. He is proficient in Spanish.

Recognition/Teaching/Speaking

Mr. Miller has been recognized in Chambers USA, The Legal 500, Northern California Super Lawyers, The Best Lawyers in America, Who’s Who Legal and Global Competition Review 100 for his antitrust work. He has served as a committee chair for several committees within the ABA Section of Litigation. Mr. Miller teaches a seminar on antitrust in high- tech industries at Berkeley Law School and has also taught a seminar on antitrust law at the University of California, Hastings College of Law. He has lectured extensively and written on a wide variety of legal topics and has been invited to lecture on the American legal system by the U.S. State Department in various Latin-American countries, including Argentina, Chile, Mexico, Panama, Uruguay and Venezuela. He is a former program director for the National Institute of Trial Advocacy and has taught at the Hastings College of Advocacy.

Mr. Miller served as an extern law clerk to California Supreme Court Associate Justice Stanley Mosk and to United States District Court Judge Stanley A. Weigel. After law school, he clerked for Judge William H. Orrick, United States District Court for the Northern District of California.
