Seth A. Schaeffer

Seth represents clients involved in general business disputes involving tort and contract claims, as well as antitrust litigation. He also litigates cases on behalf of a large credit card company in lawsuits alleging violations of the Fair Credit Reporting Act, Fair Debt Collection Practices Act and Equal Credit Opportunity Act. Similarly, he frequently litigates cases on behalf of one of the nation’s largest banks in lawsuits alleging violations of the Truth in Lending Act and the Real Estate Settlement Procedures Act. Multiple such cases have involved appeals before the U.S. Court of Appeals for the Fourth Circuit. In addition to litigation, he advises clients on antitrust compliance.

Examples of Seth’s recent experience include his representation of a large national food distributor in its defense of claims brought by former employees related to their compensation agreements; his representation of a multinational aluminum products manufacturer in connection with its alleged breach of a multimillion dollar supply contract brought by one of its vendors; his representation of a novelty ice cream cone and wafer manufacturer against claims of Sherman and Clayton Act antitrust violations. Seth also represented one of the nation’s largest bottle closure system manufacturers in a dispute with one of its vendors in connection with the purchase of a two million dollar robotic packaging system, and helped achieve a $2.5 million arbitration award in a proceeding where McGuireWoods represented a subsidiary of a public company that sued its former CEO for breach of fiduciary duty, fraud, and conspiracy. Finally, while at McGuireWoods, Seth has served as interim chief antitrust counsel for one of the world’s leading manufacturers of paper and forest products.

Seth is experienced in both state and federal courts, and has been involved in preparing and responding to pleadings, discovery requests, and dispositive motions, taking and defending depositions, preparing witnesses for depositions and trial, settlement negotiations and mediations, and oral arguments.

Prior to joining McGuireWoods, Seth was an associate at Mayer, Brown, Rowe & Mawe and a student law clerk for the Honorable Douglas F. Eaton of the U.S. District Court for the Southern District of New York.

While earning his law degree at Fordham University School of Law, Seth received the school’s Legal Writing Award and was named Best Oralist in the 2003 William B. Spong Moot Court Competition at William & Mary School of Law. As an undergraduate at Colgate University, Seth was a George C. Cobb Fellow and captain of the men’s basketball team. He received the ECAC Scholar Athlete Merit Medal and the Jack Mitchell Leadership Award.
