Shannon Nakabayashi is a senior attorney in Morgan Lewis's Labor and Employment Practice. Ms. Nakabayashi's practice focuses on a wide array of employment matters, including employment litigation and arbitration. She handles both complex and individual litigation and represents employers in all stages of litigation, from inception through trial, before state and federal courts, arbitration panels, and administrative agencies. Ms. Nakabayashi represents clients in the technology, retail, financial services, and healthcare industries.
Ms. Nakabayashi regularly counsels employers on all aspects of employment law, including risk management and litigation prevention, compliance with state and federal wage and hour laws, accommodation of employee disabilities, disciplinary issues, discrimination and harassment complaints, and employee terminations. She has also drafted and negotiated executive employment and separation agreements. Ms. Nakabayashi conducts internal investigations for clients and has conducted sexual harassment and discrimination training. She also performs wage and hour audits under California law and the FLSA.
Ms. Nakabayashi regularly speaks on issues relating to sexual harassment and compliance with state and federal leave, disability, and wage and hour laws. She has authored several amicus briefs on employment issues before the California Supreme Court and appeared on national media outlets to discuss the Court's decision in Miller v. Dept. of Corrections.
Ms. Nakabayashi represents several nonprofit charitable organizations, which focus on issues of hunger and affordable housing in the greater Bay Area. She also currently serves on the Pro Bono Committee for the San Francisco office.
Ms. Nakabayashi received her J.D., cum laude, from the University of San Francisco School of Law, where she was a law review editor and received CALI Excellence Awards for Constitutional Law and Legal Writing. Ms. Nakabayashi received her B.A. from the University of California, Berkeley, where she majored in English literature.
Ms. Nakabayashi externed for Judge Ming W. Chin, Associate Justice of the California Supreme Court.
Ms. Nakabayashi is admitted to practice in California and before the U.S. District Courts for the Northern, Eastern, Southern, and Central Districts of California and the U.S. Court of Appeals for the Ninth Circuit.
