Shay Dvoretzky

Shay Dvoretzky focuses on appellate advocacy, complex trial-level motions, and strategic counseling. He has argued before federal and state courts nationwide, including the U.S. Supreme Court and almost all the federal courts of appeal. His experience within the last year includes labor law, employment discrimination, ERISA, constitutional law, administrative law, class actions, mass torts, the False Claims Act, bankruptcy, and foreign sovereign immunity.

Shay has recently won multiple victories for CBS Corporation, including in the Second Circuit (involving class claims under ERISA), the Seventh Circuit (involving federal jurisdiction over asbestos cases removed from state court), and the South Carolina Supreme Court (involving statutory interpretation). He represents General Motors LLC in several cases arising out of the GM bankruptcy, recently winning two appeals (involving class action benefits disputes) in the Sixth Circuit.

Shay is also the lead appellate lawyer and legal strategist representing Jones Day itself in a series of cases brought by the trustees of defunct law firms who seek to recover fees earned by Jones Day by representing clients that the bankrupt firms abandoned. Shay recently argued two such appeals on consecutive days on opposite coasts, winning both cases and persuading courts in New York and California that clients are not the property of law firms.

Shay regularly speaks and writes on appellate advocacy and the Supreme Court. His pro bono practice includes victories in habeas and constitutional rights cases, with a particular interest in religious liberties cases. He serves as treasurer of the Edward Coke Appellate Inn of Court.
