Stephen W. Snively

Stephen W. Snively is a partner in Holland & Knight's Orlando office. He represents commercial real estate lenders, buyers, sellers, developers, investors, owners and managers. Mr. Snively also represents clients on other business matters.

His extensive experience representing banks, insurance companies and other institutional lenders involves the negotiation, documentation, closing, sale, assignment and workout of complex commercial real estate loans. This includes assuring compliance with lender requirements, development of strategies for the limitation of lender liability, the negotiation and drafting of loan assignment documents and resolution of issues relating to mortgagee's title insurance.

His work with developers, investors and owners of commercial real estate encompasses the negotiation and drafting of acquisition and development documents (purchase and sale agreements, development agreements, construction contracts, declarations of covenants etc.), documents for loans (acquisition, construction and refinance), leases and reciprocal easement agreements. It also includes the issuance of title insurance, survey review, coordination and conducting of complex due diligence reviews, Section 1031 tax deferred exchanges and zoning, permitting and land use approvals.

His commercial real estate loan workout practice involves the negotiation and drafting of forbearance agreements and the coordination of specialized teams of attorneys handling such related matters as environmental contamination, land use entitlements, construction liens, foreclosures and bankruptcies.

Included among the types of real estate projects with which he has been involved are retail centers (urban, neighborhood, big-box, restaurants and outparcels), high-rise office buildings, apartment complexes, mixed-use projects, residential developments, warehouse/industrial properties, a Las Vegas casino, regional aquariums and marinas.

Mr. Snively serves as Honorary Consul for The Republic of Namibia in the state of Florida and is available to assist businesses and philanthropic organizations with activities in Namibia. He also established Scholarship for Namibia, Inc., to provide scholarships to the students at The Polytechnic of Namibia seeking degrees in land surveying, planning and management. Upon graduation, these students agree to assist the government in its national resettlement effort.
