Steven A. Pozefsky

Steve Pozefsky is dedicated to the principle that litigation is only one of many ways to help clients achieve their business goals, and that first, foremost, and always, a lawyer should serve as a counselor to clients. This understanding has resulted in Steve being asked to work with clients in very strategic, business-focused ways. For example, he served as an on-site interim General Counsel for a local hospital and as a licensed lobbyist for an international business association. In his role as litigator, Steve handles litigation in state and federal courts and tribunals throughout the country on issues ranging from civil and commercial matters to construction law and government contracts. His health care litigation practice includes civil and criminal investigations and proceedings, as well as compliance and risk management.

In the area of government contracts, Steve counsels clients regarding compliance with the Federal Acquisition Regulation and the rules and regulations governing eligibility and participation in the federal government’s programs for small and disadvantaged businesses, such as the 8(a) Business Development Program and the SDVOSB Program. He litigates contract claims and bid protests before the United States Court of Federal Claims, the United States Court of Appeals for the Federal Circuit, the GAO and the Boards of Contract Appeals. He also has successfully represented government contracting clients in suspension and debarment proceedings as well as in international disputes.

Steve’s experience includes white collar criminal cases, pharmaceutical products liability defense, eminent domain litigation and contested bankruptcy disputes. He also represents banks and financial services companies in the areas of mortgage litigation and compliance, and loan enforcement. Steve has been lead or second chair counsel in numerous trials, appeals and in alternative dispute resolution settings, including a contentious, multiple-year construction dispute administered by the International Centre for Dispute Resolution. He has had direct responsibility for preparing and arguing dispositive motions and appellate briefs as well as preparing and deposing fact and expert witnesses.
