Terry Dee

is a trial lawyer with substantial experience in product liability, class action, securities and other complex litigation. He has tried cases in federal and state courts throughout the country, including Illinois, Ohio, Maryland, Arizona and Missouri, and has handled numerous commercial arbitrations. He has also served as coordinating or liaison counsel in several multi district litigation matters involving telecommunications companies where he developed the national strategy and coordinated the joint defense of those cases. Terry has also represented corporations, officers and directors in SEC investigations and securities matters.

For the last several years Terry has led the defense of Motorola and the wireless telephone industry in a series of cases claiming that wireless telephones cause adverse health effects. He successfully argued for the dismissal of several putative class actions based on the doctrine of federal preemption. His victory was profiled in Wireless Week.

In a separate individual action brought by a plaintiff who claimed wireless use had caused his brain cancer and sought $800 million, Terry was one of the lead lawyers for Motorola in a five-day Daubert hearing trial in which the Court granted defendants' motion to exclude all of plaintiffs' experts. This result was featured in several national publications, including USA Today. See also, Newman v. Motorola, 218 F. Supp. 2d 769 (D. Md. 2002), aff'd, 78 Fed. Appx. 292 (4th Cir. 2003).

Terry was one of several Kirkland attorneys involved in the representation of General Motors in a high-profile case brought by the family of former NFL player Derrick Thomas in Kansas City, Missouri. After a six-week trial, the jury returned a complete defense verdict for GM, as reported on KMBC-TV in Kansas City.
He was also one of several Kirkland attorneys involved in the representation of Motorola Inc. in the Baker v. Motorola case. This major litigation victory was profiled by The National Law Journal in Motorola Defeats Huge Property Damage Claim and as a Defense Win of the Month in Overcoming a Hurdle With Public Property Records.
