Thomas B. Kenworthy

Thomas B. Kenworthy is a partner in Morgan Lewis's Litigation and Intellectual Property Practices. Mr. Kenworthy's practice focuses on patent and intellectual property litigation, as well as commercial litigation. He represents clients in a variety of industries, including medical devices, telecommunications networking equipment, plastics and chemicals, semiconductors and semiconductor fabrication equipment, valves, helmets, and computers.

Mr. Kenworthy has tried nine patent infringement cases to verdict before juries, tried two patent-related cases to judgment, argued eight patent cases before the U.S. Court of Appeals for the Federal Circuit, and has been involved as counsel for petitioners and amici in connection with certiorari petitions in the U.S. Supreme Court involving issues of patent law and procedure. Mr. Kenworthy has also served as lead counsel representing both complainants and respondents in Section 337 investigations before the U.S. International Trade Commission. In 2008, he obtained an initial determination by the ALJ and a final determination by the full Commission that all of the asserted claims of the patent in issue were invalid. Mr. Kenworthy's appellate litigation experience includes appeals before the U.S. Courts of Appeals for the Third, Fourth, Fifth, Eighth, Ninth, Eleventh, Federal, and District of Columbia Circuits; the U.S. Court of Appeals for the Armed Forces; appellate courts of five states; and the U.S. Supreme Court.

Mr. Kenworthy has served as lead trial counsel in civil cases litigated to judgment in the state courts of Pennsylvania, New Jersey, South Carolina, Texas, and Washington, and in U.S. District Courts for the Eastern and Middle Districts of Pennsylvania; District of Delaware; Southern District of New York; Northern District of California; Northern District of Illinois; District of Massachusetts; District of Columbia; Eastern District of Virginia; District of South Carolina; Southern, Middle, and Northern Districts of Georgia; Southern District of Mississippi; and District of North Dakota.

Prior to joining the firm, Mr. Kenworthy was a law clerk to Judge Benjamin R. Jones, Chief Justice of the Supreme Court of Pennsylvania from 1973-74 and served on active duty with the U.S. Marine Corps as a Judge Advocate from 1974-78.

Mr. Kenworthy is admitted to practice in Pennsylvania and before the U.S. Supreme Court; the U.S. Courts of Appeals for the Third, Fourth, Fifth, Eighth, Ninth, Eleventh, District of Columbia, and Federal Circuits; and the U.S. District Courts for the Eastern District of Pennsylvania, the Northern District of Illinois, and the Eastern District of Texas.
